When crossing signals fail, who’s liable

I keep running into disputes after logged malfunctions under 49 CFR Part 234 where the carrier posts stop-and-flag and the county drags its feet on contractor dispatch… From a liability perspective after a crash, does FRSA preemption cover the railroad if it met the Part 234 notice/flagging steps, or do the signal maintainer and road authority still face primary exposure under the maintenance agreement? Asking because I’ve got a mediation next Tuesday and want to sanity-check how folks are seeing this play out on the ground.
